Türkiye Ratifies the OTS Digital Economy Agreement
With Law No. 7583, published in the Official Gazette on 20 June 2026, Türkiye completed domestic ratification of the Organization of Turkic States’ Digital Economy Partnership Agreement — the third member to do so, after Azerbaijan and Uzbekistan. Entry into force now awaits Kyrgyzstan and Kazakhstan.
The headlines read it as an e-commerce story. For maritime and multimodal trade, three points matter more than the coverage suggests.
First, electronic signatures are in the text as a cooperation area. A qualified electronic signature issued in Türkiye today has no automatic legal effect in Kazakhstan. If a mutual-recognition mechanism becomes operational, one signature executed in Istanbul becomes verifiable across the Caspian. We are not there yet — but for the first time, the political framework for it is signed and ratified.
Second, paperless trade and electronic transport documents. Uzbekistan’s customs-side proposal on mutual recognition of electronic transport documents is the region’s most concrete step toward an eBL pilot corridor. The Middle Corridor’s entire competitive case rests on speed; paper documents crossing five borders are that case’s negation.
Third — and most important — what the agreement does not do. DEPA is a framework agreement: soft law. Nothing in it amends the Turkish Commercial Code’s negotiable instruments regime or confers document-of-title status on an electronic record. Statutory recognition of electronic transferable records — MLETR adaptation — remains the work of each member state’s own legislature. The framework opens the corridor; national law paves it; infrastructure is what runs on it.
Our reading is plain: the tailwind is real, the gap persists. And that gap — the last legal mile between contractual and statutory recognition — is exactly the territory we map in our analysis of the Sovereign Bottleneck.
